Today, Congressman Salud Carbajal (CA-24) applauded new executive actions by President Joe Biden designed to keep American families together by protecting noncitizen spouses and children of U.S. citizens from separation or deportation and streamlining visa processes for Dreamers.

“Despite years and decades of contributions to our country and economy, thousands of American families still live under threat of forced separation because of our outdated immigration system,” said Rep. Carbajal. “These updated rules will help U.S. citizens with noncitizen spouses or children keep their families together by allowing undocumented immigrants with long histories and deep ties in our communities to remain here as they apply to change their legal status, rather than risk prolonged legal limbo or deportation.”

“President Biden continues to demonstrate a commitment to fixing our broken immigration system – with or without the help of Congressional Republicans. I will work in Congress to build on these rules, codify these actions and others to protect, and continue promoting humanity and order in our immigration system.”

The updated rules announced today by the Biden-Harris Administration will allow certain long-term undocumented individuals who are married to or are noncitizen children of U.S. citizens to remain in the United States while applying for permanent status – status they are already eligible for. Due to barriers in the current U.S. immigration system, prior rules prevented spouses or children of a U.S. citizen from adjusting their legal residence status without leaving the U.S. for years to await approval, often a lengthy bureaucratic process.

The White House estimates this order will protect roughly half a million spouses of U.S. citizens, the vast majority of whom pay U.S. taxes and are members of the U.S. labor force, and approximately 50,000 noncitizen children under the age of 21 whose parent is married to a U.S. citizen.

According to The Immigration Hub, the average undocumented spouse married to a U.S. citizen has lived in the U.S. for 16 years and is 40 years old. Many of these spouses are Dreamers or DACA recipients and came to the U.S. when they were children. The new rules will apply to noncitizen spouses who have lived in the United States for more than ten years, pass a background check, and meet all applicable legal requirements.

The executive actions announced today also streamline legal pathways for Dreamers, who immigrated to the United States when they were children through no fault of their own.

Today’s announcement will allow individuals, including DACA recipients and other Dreamers, who have earned a degree at an accredited institution of higher education in the United States and who have received an offer of employment from a U.S. employer in a field related to their degree, to more quickly receive work visas.

Rep. Carbajal immigrated to the United States when he was five years old from Mexico, and since coming to Congress, he has used his perspective as an immigrant to push for much-needed reforms to the U.S. immigration system.

In addition to cosponsoring the bipartisan American Dream and Promise Act, he is one of the co-leads of the bipartisan Farm Workforce Modernization Act, which would provide stability and fairness for farmworkers and address workforce shortages in the agriculture industry. The son of a farmworker, Rep. Carbajal spent summers growing up in Ventura County working alongside his dad in the fields, picking vegetables in Oxnard, California.

As Vice Chair of the New Democrat Coalition’s Immigration and Border Security Task Force, Rep. Carbajal has been a leader in both calling for a vote on the border security package repeatedly blocked by Congressional Republicans and crafting a framework for fixes to border, visa, and other immigration policies.

Rep. Carbajal and the Task Force rolled out their vision for bipartisan immigration and border security reform in February and have repeatedly called on Congressional Republicans to work across the aisle to make progress on reforming U.S. immigration policy.

He is also the author of the bipartisan Protect Patriot Parents Act, which would make parents of U.S. military service members eligible to adjust for Lawful Permanent Resident status, preventing potential deportations or separations of military families.

La Casa Blanca anunció hoy protecciones contra la deportación y la separación para las personas indocumentadas que han vivido y trabajado en los Estados Unidos durante años

Hoy, el Congresista Salud Carbajal (CA-24) celebra la nueva orden del Presidente Biden que van a mantener unidas a las familias americanas, proteger a las personas indocumentadas que han vivido y trabajado en los Estados Unidos durante años, y crear mejores procesos de estatus legal para los ‘Dreamers’.

“A pesar de muchos años y décadas de contribuciones a nuestro país y economía, miles de familias e individuos aún viven con la amenaza de separación o deportación debido a nuestro anticuado sistema de inmigración,” dijo el Representante Carbajal. “Estas nuevas acciones permitirán a los inmigrantes que tienen familias estadounidenses y una larga historia en nuestras comunidades, permanecer dentro del país mientras solicitan un cambio de estatus legal. Estas órdenes reducen el riesgo de un limbo legal prolongado o de la separación forzada de familias en los EE.UU.

Las nuevas reglas permitirán a las personas indocumentadas que tienen un esposo o padre que son ciudadanos estadounidenses permanecer en los Estados Unidos mientras solicitan el estatus permanente.

La Casa Blanca estima que esta orden protegerá a aproximadamente medio millón de cónyuges de ciudadanos estadounidenses, la gran mayoría de las cuales pagan impuestos y son miembros de la fuerza laboral estadounidense, y aproximadamente 50.000 niños indocumentados menores de 21 años. El Representante Carbajal emigró a los Estados Unidos cuando tenía cinco años desde México. Él ha utilizado su perspectiva en el Congreso como inmigrante y defensor de los ‘Dreamers’ de California para impulsar las tan necesarias reformas en el sistema de inmigración de los Estados Unidos.

Además de apoyar el proyecto ley Sueño y la Promesa Americana, es uno de los colíderes del proyecto de ley bipartidista de Modernización de la Fuerza Laboral Agrícola, que proporciona estabilidad y equidad a los campesinos y ayudará con los problemas de contratación en la industria agrícola. Como líder del Grupo de Trabajo sobre Inmigración y Seguridad Fronteriza, de la Coalición de Nuevos Demócratas en la Cámara, el congresista Carbajal ha sido una de las voces en favor de una votación sobre el paquete de seguridad fronteriza bloqueado repetidamente por los republicanos del Congreso, y también ha llamado por reformas migratorias que incluye fortalecer nuestra seguridad fronteriza, y modernizar nuestras pólizas de visas y de otro tipos de inmigración.

El Congresista Carbajal y el Grupo de Trabajo dieron a conocer su visión de una reforma bipartidista de la inmigración y la seguridad fronteriza en Febrero, y han pedido repetidamente a los republicanos del Congreso que trabajen en forma bipartidista para avanzar las reformas de inmigración.

También, el Congresista Carbajal es el autor del Proyecto de ley de Protección de los Padres Patriotas. Este proyecto de ley bipartidista evitaría posibles deportaciones o separaciones de familias militares.
